Terms of Service – A Focused Drug Consortium

Terms of Service

Last Updated: June 24, 2026

Welcome to A Focused Drug Consortium. By signing up, you agree to these terms.

1. Our Service

A Focused Drug Consortium is a 100% online digital platform that helps motor carriers stay FMCSA compliant.

We do not perform drug screenings ourselves. Instead, we connect you and your drivers to eScreen Go Tier 1 clinics nationwide that use fully electronic chain-of-custody forms.

How it works:

  • Your admin team shares a pre-generated test code with the driver (example: Focused1001).
  • The driver visits the eScreen Go link, enters the code and their location.
  • The system shows the closest participating clinics, including nights and weekend options.
  • Different codes are available for different needs (pre-employment, random, post-accident, reasonable suspicion, SAP, etc.).

This system eliminates paper forms, payment portals, phone calls, and scheduling hassles for your team.

2. What We Provide

  • Client Portal: Access to your dedicated eScreen account where you can log in directly to view test results. Your test results are available in the portal, and you will also receive them via email.
  • SAP Program Support: We receive the testing requirements from the Substance Abuse Professional (SAP) and alert you when your driver needs to complete return-to-duty or follow-up testing.
  • SAP Provider Recommendations: We can provide recommendations for qualified SAP providers and counselors in your area.
  • FMCSA Drug & Alcohol Clearinghouse Support: We will register and enroll your company in the FMCSA Clearinghouse (or assist with designation if already registered) so you can meet pre-employment and annual query requirements. We can also support reporting of violations and return-to-duty information as permitted.
  • Pre-Generated Test Codes: Codes are assigned to your company at the time of account creation (typically within 2–5 business days after your initial annual fee payment).
  • Nationwide Clinic Network: Connection to eScreen Go Tier 1 clinics for convenient testing, including nights and weekends.

3. Regulatory Compliance

We operate in full compliance with 49 CFR Part 382 (FMCSA Controlled Substances and Alcohol Use and Testing) and 49 CFR Part 40 (DOT Procedures for Transportation Workplace Drug and Alcohol Testing Programs).

4. Pricing & Membership Plans

  • Shared Pool (up to 5 drivers): $25 per driver per year
  • Shared Pool (6+ drivers): $150 per year (flat rate)
  • Private Pool: $450 per year

These fees cover your annual pool membership only. Drug screening fees (such as the $55 5-Panel DOT test) are charged separately at the time of testing.

Adding Drivers

Your membership year runs for 12 months from your signup/renewal date (anniversary billing). You may add drivers at any time:

  • On the lowest tier, each new driver is charged $25 prorated for the remaining months in your current membership year.
  • If adding drivers causes your total to reach 6 or more, your plan will automatically upgrade to the $150 flat annual shared pool rate. You will be charged the prorated difference for the remaining portion of your membership year.

5. Payments

You must keep a valid credit card on file at all times.

By confirming your subscription, you authorize A Focused Drug Consortium to charge the credit card on file for drug screenings and any related fees (including after-hours or cancellation fees) at the time of testing or shortly thereafter.

6. Random Testing

Drivers in the shared pool are subject to random selection in accordance with current FMCSA requirements (50% for drug testing and 10% for alcohol testing).

7. Cancellations & Refunds

  • You can cancel your membership at any time.
  • Annual membership fees are non-refundable.
  • Screening fees and after-hours cancellation fees for completed or dispatched tests are non-refundable.

8. Conduct & Reservation of Rights

It is our pleasure to do business with you. Unfortunately, there are people who believe it is appropriate to make others miserable. If you engage in excessive rudeness, flagrant, or inappropriate behavior toward our team, we reserve the right to refuse service and not share our great deals or shared pools.

9. Your Responsibilities

  • Keep a valid credit card on file
  • Keep driver information current in your portal
  • Respond promptly to any testing notifications
  • Ensure your drivers use the correct test codes

10. On-Site Collections

On-site drug and alcohol testing is available upon request during standard hours (7:00 a.m. – 9:00 p.m.). Pricing follows the contracted per-test rate plus applicable on-site event fees and a $5 administrative fee per test.

Collections requested outside standard hours, rush requests (less than 72 business hours' notice), and cancellations (less than 48 business hours' notice) may incur additional fees, including a minimum $500 on-site commitment fee.

11. After-Hours & Post-Accident Testing

For post-accident situations requiring an on-site collector, clients can call our eScreen after-hours line (available 24/7).

We will provide you with the after-hours number and our regular customer service number.

Important notes on after-hours testing:

  • After-hours testing (especially on-site collections) may cost more depending on the time and travel distance required for the collector.
  • If you request a collector for an after-hours test and then cancel after the collector has been dispatched, eScreen will charge a $500 cancellation fee.

All other communications will be handled during normal business hours (Central Standard Time).

12. Our Responsibilities

We will maintain your FMCSA-compliant pool membership, provide pre-generated test codes, and ensure access to the nationwide eScreen Go clinic network.

13. Limitation of Liability

Our liability is limited to the amount you paid for the current membership year. We are not responsible for any indirect, incidental, or consequential damages.

14. Governing Law

These terms are governed by the laws of the State of Texas.
